You agree that these provisions above apply to you, your family, heirs, executors and anyone else who may be able to bring a legal action on your behalf in the future. You hereby indemnify and hold harmless THE EVENT from any and all liability for any property damage or personal injury to any third party resulting from your participation in THE EVENT. Terms & Conditions Registering for THE EVENT secures a space for you at THE EVENT listed above. Early online registration prior to THE EVENT is strongly encouraged as space is limited.

Refund Policy

There are no refunds. If a musical act is unable to perform no refunds will be given. If the event is cancelled for any reason the ticket will be valid for the next year the event is held.

Commitment to Act Prudently

You commit to act prudently and respectfully towards all participants and facilitators at THE EVENT. You agree to be of sound mind before, during and after the event, this includes not being under the influence of any substance that affects your behaviour (i.e. including but limited to alcohol, drugs, etc.). You are responsible for your own actions no matter what state of mind you are in. You understand that any foolish, demeaning, negative, threatening or provocative behaviour may result in you being asked to leave the event immediately. If you are asked to leave, you will not be provided a refund or transfer of any kind, for any reason. Exclusion of Liability Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we are only liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our own event and/or service.

Media Release

You agree to grant THE CUP (FORMERLY THE DEIGHTON CUP) the irrevocable right and permission to use, throughout the world and in perpetuity, your image, likeness, photographs, video content, audio recordings or any other record of your participation at THE EVENT, whether captured by us or you for any purpose, including commercial use. For example, if we film a promotional video of THE EVENT and you are visible in it, you grant THE CUP (FORMERLY THE DEIGHTON CUP) the permission to use this recording on any of our platforms including but not limited to our websites, social media channels, or for any purpose whatsoever without asking your permission. If you post a photo or video from THE EVENT on your social media page, we can repost without asking your permission.

Jurisdiction

This Agreement will be governed by the laws of VANCOUVER, BC CANADA. This Agreement will be governed by the laws of the jurisdiction in which the event is held.

Severability

If any provision of this Agreement is invalid or unenforceable, the other provisions in the Agreement will remain in full force and effect.

Headings

The headings used in this Agreement are for stylistic purposes only and none of the content in the headings are intended to be legally binding.

Weather

The event is rain or shine.

I have read and understand this release prior to registering for this event, I am fully familiar with all terms herein and I warrant and represent that I have the full right, authority and capacity to register and attend this event and grant the rights stated herein.

BY ATTENDING THIS EVENT I AM GIVING UP CERTAIN RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE. I CONFIRM THAT I AM AT LEAST 19 YEARS OLD AS OF THE DAY THIS FORM WAS FILLED OUT. I FREELY ACCEPT AND ASSUME ALL RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF RESULTING PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS DIRECTLY OR INDIRECTLY ASSOCIATED WITH MY PARTICIPATION IN THE EVENT. I HAVE READ THIS VOLUNTARY ASSUMPTION OF RISK, RELEASE AND INDEMNITY AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS AND VOLUNTARILY AGREE TO IT’S TERMS.
